As we can accept your order and make a legally enforced agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with.
1. Introduction
Welcome to Darling Bun Shop ( ''We'', ''us'', ''our'' or ''company''). These Terms and Conditions is a legal agreement made between you as a customer and Darling Bun Shop. By ordering any of the goods from us and using the website you agree to be bound by these Terms and Condition. Please note that you can only purchase from us if you are eligible to enter a contract and are at least 18 years old.
If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at help@darlingbunshop.co.uk so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.
2. Communications
By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at help@darlingbunshop.co.uk
3. Purchases
If you wish to purchase any product or service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including but not limited to, your credit or debit card number, the expiration date of your card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.
We may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.
4. Modification to the service and prices
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
5. Subscriptions
Some parts of Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles will be set depending on the type of subscription plan you select when purchasing a Subscription.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Darling Bun Shop cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting our customer support team at help@darlingbunshop.co.uk
A valid payment method is required to process the payment for your subscription. You shall provide Darling Bun Shop with accurate and complete billing information that may include but not limited to full name, address, state, postal or zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorise Darling Bun Shop to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, Darling Bun Shop reserves the right to terminate your access to the Service with immediate effect.
6. Products
The description of the products is as set out on the website, media and other form of advertisement is for illustrative purposes only and there may be a small difference in size, colour, shape of the products.
In the case of any products made to your special requirements, it is your responsibility to ensure that any information/specification you provide is accurate.
All products which appear on the Website are subject to availability
We may make changes to the products and will notify you of these changes on our social media.
7. Fee Changes
Darling Bun Shop may modify Subscription fees for the Subscriptions at any time. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
Darling Bun Shop will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
8. Personal information
We retain and use all information strictly under the Privacy Policy
We may contact you by using e-mail/other electronic communication and by pre-paid post and by purchasing from us you agree to this.
9. Content
Content found on or through this Service are the property of Darling Bun Shop or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.
10. Prohibited uses

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
11. Accounts
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorisation. You may not use as a username any name that is offensive, vulgar, or obscene.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
12. Intellectual Property
Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Darling Bun Shop and its licensors. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Darling Bun Shop.
13. Error Reporting and Feedback
You may provide us either directly at info@darlingbunshop.co.uk or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire, or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Company and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialise) Feedback in any manner and for any purpose.
14. Links to Other Web Sites
Our Service may contain links to third party web sites or services that are not owned or controlled by Darling Bun Shop.
Darling Bun Shop has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.
You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party websites or services.
We strongly advise you to read the terms of service and privacy policies of any third-party websites or services that you visit.
15. Basis of sale
The description of the products on our website does not constitute a contractual offer to sell the products. Thus, when the order has been submitted on the website, we may reject it for any reason, and will let you know what the reason is.
The order process is set out on the website and each step allows you to check and amend any errors before submitting the order. It is your responsibility to check that you have used the ordering process correctly.
A contract will be formed for the sale of the products only when you receive an email from us confirming the order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the order placed by you. By placing an order you agree to us giving you confirmation of the contract by means of an email with all information in it (ie Order Confirmation). You will receive the Order Confirmation within a reasonable time after making the contract/purchase in any event, not later than the delivery of any products supplied under the contract.
We intend that these Terms and Conditions apply only to a contract entered into by you as a consumer. If this is not the case, you must tell us.
16. Price and Payment
The price of the product and any additional delivery/other charges is that set out on the website at the date of the order.
You must pay by submitting your credit/debit card detail with your order we can take payment immediately/otherwise before delivery of the goods.
17. Delivery
We dispatch and do our best to deliver the products to the delivery location by the time/within the agreed period. However, you must understand that we as a business are not in control of the post and are not responsible for any delays or failed deliveries. Thus, if you have an issue, please contact us. You must wait for 10 days after the expected delivery date to claim that your order has been lost to claim a refund/replacement.
If your product is delivered after a refund/replacement is made, you must return the products back to us within the next 7 business days and we will pay for the cost of this.
Delivery outside England, Wales, Scotland, Northern Ireland, Isle of Man and Channels Islands you may need to pay import duties/other taxes, as we will not pay them.
If you/your nominee fail, through no fault of ours, to take the delivery of the products at the delivery location you have entered and failed to collect our product from post office on time, we may charge the reasonable cost of redelivering them if the items return to us.
18. Withdrawal, returns and cancellation
You can withdraw/cancel your order before it has been dispatched by contacting us via the website, email, or other forms of media. Unless it is a custom/clearance product.
We have a 14-day return policy, which means you have 14 days after receiving your item to request a return. To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.
To start a return, you can contact us at help@darlingbunshop.co.uk or other social media with a brief description of the issue and proof (photo/video) if required. Once you have done this we will do our best to respond to you as soon as possible. If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.
You must keep the receipt from the post office as proof of postage in case any issues arise. Please note that if the return will get lost and will not get to us, a refund will not be issued unless you provide the proof of postage.
Damages and issues
Please inspect your order upon delivery and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.
Exceptions / non-returnable items
Certain types of items cannot be returned, such as food (treats) and custom products (e.g. special orders and personalised items). Please note that we will not accept returns if your pet simply dislikes our products, pets have their own taste and preferences and we are only responsible for the quality of the products. Furthermore, we will not accept returns if oat cookies and other treats arrive damaged. We can guarantee that all products are sent in excellent condition and well packed, but we cannot take responsibility for couriers and how they handle our parcels. Yet, please don’t hesitate to get in touch if you have questions or concerns about your order and we will provide you with the best solution possible. Unfortunately, we cannot accept returns on gift cards.
Toys: We will only offer a full refund if the toy is severely damaged e.g. snapped in half and cannot be used. Toys that arrived with minor damage will be offered a partial refund since the toys can still be used without issues.
Exchanges
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.
Refunds
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too. We will refund the full order amount minus the shipping costs for the return (unless the reason for the return is our fault).
19. Conformity
We have a legal duty to supply the goods in conformity with the contract and will not have conformed if it does not need the following obligations
Upon delivery, the products will
i) be satisfactory quality
ii) be reasonably fit for the particular purpose stated in the product description
iii) conforms to their description
20. Privacy
Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulations with the regard to your personal information.
These Terms and Conditions should be read alongside, and are in addition to our policies, including our privacy policy and cookies policy
For the purposes of these Terms and Conditions:
i) 'Data Protection Laws' earns any applicable law related to the processing of Personal Data, including, but not limited to the GDPR
ii)'GDPR' means the UK General Data Protection Regulation.
iii)'Data Controller', 'Personal Data' and the 'Processing shall have the same meaning as in the GDPR.
We are a Data Controller of the personal Data we process in providing the goods for you. You supply your Personal Data to us so we can provide goods to you, and the process that Personal Data in the course of providing the goods to you. we will comply with the obligations imposed by the Data Protection Laws:
i) before/at the time of collecting Personal Data, we will identify the purposes for which the information is being collected.
ii)we will only Process Personal Data for the purposes identified.
iii)we will respect your rights in relation to your Personal Data; and
iiii)we will implement technical and organisational measure to ensure your Personal Data is secure.

21. Disclaimer of Warranties; Limitation of Liability
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Darling Bun Shop, our directors, employees, affiliates, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Darling Bun Shop and our affiliates, directors, licensors, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
25. Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms shall be governed and construed in accordance with the laws of United Kingdom, which governing law applies to agreement without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.
We try to avoid any disputes, so if the dispute occurs customers should contact us to find solution. We aim to respond within an appropriate solution within 5 working days.

We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.
